Governor Brown recently ordered Oregon OSHA to adopt new permanent rules for employees working in “high heat” and “smoke”. The new rules for heat go into effect June 15, 2022, with the new smoke rules going into effect July 1, 2022. The original rules as directed by the governor would have led to work stoppage when high heat and smoke or air particulates exist. Due to efforts by OHBA and others, the updated rules are more prescriptive and the most problematic, OSHA directed pay, rest break periods and work stoppage, requirements only occur at very high levels of smoke (above 500 AQI) and heat (above 100). However the rules still include other new requirements employers will need to take in order to remain operational at lower temperatures and smoke levels. HBA, OHBA and others are concerned that the rules exceed state and federal law and that these rules have been implemented without a vote of the legislature. OHBA, along with partner organizations, are considering a formal request for delay as well as other actions to address these concerns. To help our contractors and members get up to speed and be in compliance while they question the validity and timing of these rules, OHBA is developing a training program and “tool” kit.
