Earlier this month, HBA provided a letter to the City of Sandy’s Planning Commission, encouraging the City to adopt and apply only clear and objective standards regulating the development of housing. Currently, Sandy’s development code includes discretionary standards that could be used to deny certain housing development applications. However, ORS 197.307 requires local governments to adopt and apply clear and objective standards for these permit applications. ORS 227.175(4)(b)(A) further states that local governments may not deny a permit if the proposed development complies with such clear and objective standards. HBA’s letter to Sandy was prompted by the City’s discretionary denial of a recent proposed subdivision. The letter neither supports nor opposes the individual proposed project, which will be heard by the Planning Commission next month.
