HBA Presents Middle Housing Legislation for Portland and Beyond


This summer, HBA has presented middle housing related legislation to over 250 builders, realtors, lenders and title officers associated with HBA-members First American Title Company and Lawyers Title. The presentations cover House Bill 2001 (2019) and companion Senate Bill 458 (2021); along with Portland’s Residential Infill Project (RIP), which went into effect August 1, 2021; and RIP 2.0, effective on or before June 30, 2022. While HBA-championed HB2001 paved the way for building more diverse housing types in single dwelling zones, SB458 allows for an expedited land division process for middle housing, offering a speedier path to delivering more homeownership options. SB458 becomes effective June 30, 2022 for qualifying middle housing permit applications. Portland’s RIP, passed in 2020 and effective August 1, 2021, applies to R2.5-R7 single dwelling zones. While it largely complied with HB2001 middle housing requirements, RIP 2.0 will address outstanding housing requirements for the larger R10 and R20 single dwelling zones, as well as create a townhome and cottage cluster code across all single dwelling zones.
