Recalcitrant cities have for decades refused to recognize the right to build homes on legally platted lots. Using minimum lot size requirements and unreasonable delay tactics, these jurisdictions skirt state law and inhibit the creation of much needed entry-level housing. However, thanks to the HBA and the Oregon Legislature, local governments must allow the construction of single-family homes on residential platted and zoned lots. Due to significant support in the Legislature, SB 534 - an HBA priority bill - overcame opposition from cities and NIMBY activists and, once signed, will go into effect on March 1, 2020. Smaller lots allow for the creation of price attainable starter homes, which are dearly needed throughout the Portland Metro region. As we previously discussed in the pages of the Home Building News (our monthly industry magazine) refusing to permit smaller homes in existing neighborhoods is a typical method that anti-housing activists use to stall the creation of new units. The HBA thanks SB 534 sponsors Senators Baertschiger Jr. (R-Grants Pass) and Fagan (D-Portland) for their efforts to ensure that builders are able to bring new homes to existing communities throughout the state.
